These Terms and Conditions (“Terms”) govern all bookings, reservations, tours, transportation services, holiday packages, excursions, and related travel services provided by Secret Pearl Travels (Pvt) Ltd (“Company”, “we”, “us”, or “our”). By making a booking through our website, email, telephone, WhatsApp, social media channels, travel partners, or any other communication method, you (“Customer”, “Traveler”, “Guest”, or “you”) agree to be bound by these Terms.
1. BOOKING CONFIRMATION AND PAYMENT
1.1. A booking request shall be considered provisional until confirmed in writing by the Company.
1.2. A deposit or full payment may be required at the time of booking depending on the selected travel package and supplier requirements.
1.3. Full payment must be received prior to the commencement of travel unless otherwise agreed in writing.
1.4. Accepted payment methods include bank transfer, credit/debit cards, online payment gateways, and other payment methods approved by the Company.
1.5. Any bank charges, transaction fees, currency conversion fees, or intermediary charges shall be borne by the Customer.
1.6. The Company reserves the right to cancel any reservation where payment has not been received within the agreed timeframe.
2. PRICING AND CURRENCY
2.1. Prices may be quoted in Sri Lankan Rupees (LKR), United States Dollars (USD), Euros (EUR), or other currencies as specified by the Company.
2.2. Exchange rate fluctuations may affect quoted prices until full payment has been received.
2.3. All prices are subject to availability and may change without prior notice until a booking is confirmed.
2.4. Confirmed bookings shall not be affected by subsequent price changes unless imposed by government authorities, suppliers, taxes, or unforeseen regulatory requirements.
2.5. Child rates, extra bed charges, and special pricing conditions may apply depending on the selected accommodation, transportation, or activity provider.
3. TOUR PACKAGES AND SERVICES
3.1. The Company provides inbound tourism services including but not limited to:
(a) Multi-day tour packages
(b) Day excursions
(c) Hotel and accommodation bookings
(d) Airport transfers
(e) Transportation services
(f) Tour guiding services
(g) Adventure activities and excursions
(h) Customized travel itineraries
3.2. Tour itineraries are provided as guidance and may be modified due to operational requirements, weather conditions, supplier availability, road conditions, government restrictions, or circumstances beyond the Company’s control.
3.3. The Company reserves the right to substitute hotels, transportation providers, attractions, or services with alternatives of similar standard when necessary.
4. CUSTOMER RESPONSIBILITIES
4.1. Customers are responsible for ensuring that all personal information provided during booking is accurate and complete.
4.2. Customers must possess valid passports, visas, travel documents, permits, vaccination certificates, and any other documentation required for travel.
4.3. The Company shall not be responsible for losses arising from incomplete or invalid travel documentation.
4.4. Customers must comply with local laws, customs, regulations, and instructions issued by guides, drivers, hotel operators, and relevant authorities.
4.5. Any damage caused by a Customer to vehicles, hotels, attractions, or third-party property shall be the sole responsibility of the Customer.
5. HOTEL ACCOMMODATION
5.1. Hotel accommodations are subject to the terms and policies of the respective accommodation providers.
5.2. Standard hotel check-in and check-out times shall apply unless otherwise stated.
5.3. Early check-in and late check-out requests are subject to availability and may incur additional charges.
5.4. Hotel classifications and star ratings are determined by the relevant authorities or hotel operators and not by the Company.
6. TRANSPORTATION SERVICES
6.1. Transportation services shall be provided according to the confirmed itinerary.
6.2. Vehicle allocation shall depend on passenger numbers and operational requirements.
6.3. Customers are responsible for arriving at designated pickup locations at the agreed time.
6.4. Delays caused by Customers may result in shortened services, additional charges, or cancellation without refund.
6.5. The Company shall not be liable for delays caused by traffic congestion, road closures, accidents, weather conditions, mechanical breakdowns, or governmental restrictions.
7. CHANGES, AMENDMENTS, AND CANCELLATIONS
7.1. Requests for amendments must be submitted in writing and are subject to availability and supplier approval.
7.2. Cancellation charges may apply depending on the timing of cancellation and the policies of hotels, transport providers, and other suppliers.
7.3. Unless otherwise specified in the booking confirmation:
(a) More than 30 days before arrival – Full refund less administrative charges.
(b) 15–30 days before arrival – Up to 50% cancellation fee.
(c) Less than 15 days before arrival – Up to 100% cancellation fee.
7.4. Certain hotels, flights, train tickets, permits, and special event bookings may be non-refundable.
7.5. Refund processing times may vary depending on the payment method and financial institutions involved.
8. FORCE MAJEURE
8.1. The Company shall not be liable for any cancellation, delay, alteration, loss, or failure to perform resulting from circumstances beyond its reasonable control, including but not limited to:
(a) Natural disasters
(b) Extreme weather conditions
(c) Floods, landslides, or earthquakes
(d) Civil unrest or political instability
(e) Government regulations or restrictions
(f) Epidemics or pandemics
(g) Transportation disruptions
(h) Acts of terrorism
(i) Strikes or labor disputes
8.2. In such situations, the Company shall make reasonable efforts to provide alternative arrangements but cannot guarantee refunds from third-party suppliers.
9. HEALTH, SAFETY, AND TRAVEL RISKS
9.1. Customers participate in all tours and activities at their own risk.
9.2. Customers must disclose any medical conditions, allergies, disabilities, mobility limitations, or special requirements prior to travel.
9.3. Adventure activities, wildlife encounters, water-based activities, hiking, and similar experiences involve inherent risks.
9.4. The Company reserves the right to refuse participation in activities where safety concerns exist.
9.5. Customers are strongly advised to obtain comprehensive travel insurance covering medical expenses, accidents, trip cancellation, baggage loss, and emergency evacuation.
10. LIMITATION OF LIABILITY
10.1. To the fullest extent permitted by law, the Company shall not be liable for:
(a) Personal injury, illness, accident, or death
(b) Loss, theft, or damage to personal belongings
(c) Delays, interruptions, or itinerary changes
(d) Actions or omissions of third-party suppliers
(e) Flight cancellations or schedule changes
(f) Acts of nature or wildlife encounters
10.2. The Company’s liability shall be limited to the amount paid directly to the Company for the affected service.
10.3. The Company acts as an intermediary between Customers and independent service providers and shall not be responsible for their acts, omissions, or failures.
11. THIRD-PARTY SUPPLIERS
11.1. Hotels, airlines, transportation companies, activity providers, guides, and other suppliers operate independently of the Company.
11.2. Services provided by third parties remain subject to their own terms, conditions, and operating policies.
11.3. The Company shall not be responsible for any failure, cancellation, delay, negligence, or breach by any third-party supplier.
12. DATA PROTECTION AND PRIVACY
12.1. The Company collects personal information solely for booking, operational, customer service, and legal compliance purposes.
12.2. Personal information may be shared with hotels, transportation providers, activity operators, government authorities, and other relevant service providers where necessary to fulfill travel arrangements.
12.3. The Company will take reasonable measures to protect personal information but cannot guarantee absolute security of electronic communications.
13. INTELLECTUAL PROPERTY
13.1. All content appearing on the Company’s website, brochures, itineraries, photographs, logos, and marketing materials remains the property of Secret Pearl Travels (Pvt) Ltd unless otherwise stated.
13.2. Unauthorized reproduction, distribution, or use of such materials is prohibited.
14. GOVERNING LAW AND JURISDICTION
14.1. These Terms shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka.
14.2. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
